By checking the acknowledgment box and completing your purchase through Square, you confirm that you have read, understood, and agreed to the terms of this Liability Waiver and Release of Claims ("Waiver"). This Waiver is a legally binding agreement between you ("Client") and TrudyFit, including its owner(s), trainers, contractors, employees, agents, and affiliates (collectively, "TrudyFit").
1. ASSUMPTION OF RISK
I understand that participation in fitness training, exercise programs, physical activity, nutritional guidance, virtual training sessions, in-person training sessions, consultations, and related services (collectively, "Activities") involves inherent risks. These risks include, but are not limited to, muscle strain, sprains, cardiovascular events, dizziness, falls, aggravation of pre-existing conditions, serious injury, or death.
I knowingly, voluntarily, and expressly assume all risks, whether known or unknown, foreseeable or unforeseeable, associated with my participation in the Activities.
2. MEDICAL RESPONSIBILITY
I affirm that I am physically capable of participating in the Activities and that I have no medical condition that would make participation unsafe, or that I have consulted with and received approval from a licensed physician prior to participation. I understand that TrudyFit does not provide medical advice and that all information provided is for educational purposes only.
3. RELEASE OF LIABILITY
In consideration for being permitted to purchase and participate in TrudyFit Activities, I hereby release, waive, discharge, and hold harmless TrudyFit from any and all claims, demands, causes of action, damages, or liabilities of any kind arising out of or related to injury, illness, property damage, or death that may occur as a result of my participation, including claims based on negligence, to the fullest extent permitted by law.
4. AGREEMENT NOT TO SUE
I agree that I will not bring or maintain any lawsuit, claim, arbitration, or legal action against TrudyFit for any injury, loss, or damage arising from my participation in the Activities.
5. INDEMNIFICATION
I agree to indemnify and hold harmless TrudyFit from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of my participation in the Activities or my violation of this Waiver.
6. VIRTUAL, IN-HOME & SELF-DIRECTED TRAINING
I acknowledge that virtual training, recorded workouts, and in-home sessions involve additional risks due to limited supervision and environmental factors. I accept full responsibility for ensuring a safe workout environment, appropriate equipment use, and adherence to instructions.
7. NO GUARANTEES
I understand that TrudyFit makes no guarantees regarding fitness results, weight loss, strength gains, or health outcomes.
8. GOVERNING LAW
This Waiver shall be governed by and interpreted in accordance with the laws of the state in which TrudyFit operates.
9. DIGITAL ACCEPTANCE & ACKNOWLEDGMENT
By checking the box during Square checkout and completing my purchase, I acknowledge and agree that:
I have read and fully understand this Waiver.
I am voluntarily giving up certain legal rights, including the right to sue.
My electronic acceptance constitutes a legally binding signature.
This Waiver applies to all current and future TrudyFit services unless otherwise revoked in writing.
